Terms of service

This Agreement is legally binding between you (“User”, “you” or “your”) and IPlumVPN B.V(“we”, “us” or “our”). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Keep Your Home IP, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 1 - GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 2 - VPN SERVICE

You understand that IPlumVPN B.V. is in the business of selling hardware and providing VPN services. Kindly note that the said hardware will be connected to your home internet connection, and you will be provided with two routers for home use and a travel one. VPN will be established between these two devices only. You further understand that IPlumVPN B.V. collaborates with a partner manufacturer to design and produce the hardware and/or routers. You agree to abide by these Terms with respect to your use of the Service.

SECTION 3 - SUBSCRIPTION AND AUTO-RENEWALS

Subscription. All our services are provided on a subscription basis, allowing you to select the subscription period and payment method that best suits your needs. By purchasing a service, you acknowledge that you have chosen the subscription period and payment method that works best for you.

A full list of Subscription plans and pricing is available on the Site. IPlumVPN B.V. reserves the right to amend subscription fees or institute new fees at any time upon reasonable advance notice. Any changes to the pricing will not affect the Subscriber’s current subscription period and will become effective upon subscription renewal.

Auto-Renewal.In order to ensure uninterrupted service, your subscription will automatically renew at the end of each service period, unless you provide written notice of cancellation before the renewal date. The renewal term will be the same as the original subscription period, unless otherwise specified. We will charge the subscription fee to the payment method you last used, unless you have updated your payment method or provided written notice of a change. Auto-renewal is enabled by default for payment methods that support it, including but not limited to credit cards and PayPal. If you do not cancel your subscription, we will charge your chosen payment method the current renewal price for the next service period.

SECTION 4 - YOUR USER ACCOUNT

Creating an Account. To access and use our Services, you must create an Account by providing certain information, including but not limited to your email address, password and billing information. You agree to provide complete, accurate, and up-to-date information, and to update your Account information as necessary. All KYHIP Accounts are non-transferable and may not be shared with or used by any other person.

Confidentiality of and Access to the Account. You acknowledge that you are solely responsible for all usage and activities that occur under your Account or password, including any unauthorized use by others. You agree to maintain the confidentiality of your Account and password, and to restrict access to your Account by any other party.

To protect your Account, you must keep your password confidential and not reuse it with other services. You must also immediately notify us of any unauthorized use of your Account or password.

SECTION 5 - SUBSCRIPTION CANCELLATION AND REFUND POLICY

Subscription Cancellation. You have the right to cancel your Subscription at any time, thereby terminating the automatic renewal of your Subscription for the upcoming Service period. Please note that cancellation of your Subscription will not entitle you to a refund for the unused portion of the ongoing Service period.

Subscription Refund. We are committed to your satisfaction with our Services. If, for any reason, you are not satisfied with our Services, you may cancel your Subscription and request a refund within thirty (30) days of your initial purchase, under the “ Money Back Guarantee”. Please note that this guarantee only applies to new Subscribers and does not apply to renewed Subscriptions. We reserve the right to deny a refund to any Subscriber who has previously received a refund under this policy. If you are not satisfied with our Services, you may cancel your Account within thirty (30) calendar days of your initial purchase and, upon request, you will receive a full refund of the amount you paid. We would be happy to troubleshoot any issues you may have experienced with our Services before you decide to request a refund. Once the refund is issued to you, you will lose access to the Services for which you were refunded.

Pro Rata Refund. Refunds beyond the 7-day will be considered at the sole discretion of IPlumVPN B.V. if a subscriber can demonstrate that the services were not available or usable during the subscription period and that reasonable attempts were made to contact KeepYourHomeIP to resolve the issue. In this case, KeepYourHomeIP may provide the subscriber with a pro-rata refund of service fees paid during the period when the service was not available or usable.
A Subscription longer than one month which has been renewed and purchased from Germany (after March 1, 2022), Netherlands, or the United Kingdom, is eligible for either: (i) a full refund, if a refund request is made within thirty (30) days of being charged for automatic renewal; or (ii) if the mentioned thirty (30) days term has passed - a pro rata (partial) refund for the period left in your renewed Subscription, beginning the month after you request the refund.

Equipment Refund
We accept returns within 30 days of your original purchase date. During this time frame, you can test the network and devices to ensure they meet your requirements. If, for any reason, you are not fully satisfied with KYHIP VPN solution, you can return it. To be eligible for a refund, you will need to provide the receipt or proof of purchase in its original condition.

Payment of Refund. Refunds are generally processed within ten (10) days and are made to the original form of payment used for the purchase.

SECTION 6 - ELIGIBILITY

You must be at least 18 years of age to use the Website and Services. By using the Website and Services and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age.

SECTION 7 - FEE

You agree to pay IPlumVPN B.V. a one-time fee for the hardware. These fees will be due as and when demanded by Keep Your Home IP. Additionally, Subscription plans will be charged according to your chosen plan and will be automatically renewed unless canceled as specified. Please refer to Section 4 for further details.

SECTION 8 - DISCLAIMER

7.1 IPlumVPN B.V. does not in any way encourage or advise you to violate the terms of your contract with your employer. To that effect, IPlumVPN B.V. cannot be deemed liable for your acts or omissions and any ensuing consequences thereafter.

7.2 IPlumVPN B.V. provides no warranty of the Services. IPlumVPN B.V. shall not be liable for damages which may occur following the exposure of the identity or the IP address of the user due to improper usage of the hardware or service.

7.3 You acknowledge that once you receive the equipment from IPlumVPN B.V. and perform auto-configuration, you automatically attain sole and exclusive ownership of the VPN infrastructure thus assuming full responsibility and accountability for the same in the event of an act or omission that violates the laws of your country of residence.

7.4 We do not make any warranty that your KeepYourHomeIP VPN infrastracture will meet your requirements, or that it will be uninterrupted, secure, or error-free, or that defects, if any, will be corrected. We are not responsible for data, messages, or pages lost, not delivered, delayed, because of interruptions or performance and network issues. We encourage our customers to conduct an initial test of their KYHIP VPN, to ensure that it aligns with their specific criteria and preferences.

VPN speeds, latency, and the overall quality of your connection may vary based on several factors beyond our control. The performance of the VPN connection is contingent on the network capabilities at two primary locations:

VPN Server Location: The upload speed at the location where our VPN server is installed plays a crucial role. We recommend a minimum upload speed of 30Mbps for optimal performance.

Stay Location with VPN Travel Router: For an effective and smooth connection, we recommend a minimum upload and download speed of 30Mbps at the location where your VPN travel router is connected.

We strive to provide a reliable and efficient service, but please be aware that various user-specific scenarios can impact your VPN performance and can contribute to variations in VPN performance, including:

  • Utilization of corporate VPNs.
  • The presence of antivirus software or any other applications that may affect performance.
  • Individual user setups and configurations.
  • Latency and distance – the distance between the VPN server and travel router, as well as extra latency, can greatly impact the available speed and customer experience.

SECTION 9 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 10 - INDEMNIFICATION

You agree to indemnify and hold IPlumVPN B.V. and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any alleged claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your access to or use of the services. The user is solely responsible for his or her actions when using our services.

SECTION 11 - LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. IPlumVPN B.V. does not in any way guarantee or warrant that its hardware and the KYHIP VPN will be free from any defects, errors and/or bugs once configuration has been completed. IPlumVPN B.V. does not in any way warranty or represent that the KYHIP VPN will be free from any defects, errors and/or bugs such as downtime, loss of data, corrupt data, service delay, mistakes, out-of-date information, and other causes which will be dependent on the Internet Service Providers (ISP) to which the server and your router are connected.

11.1 In the event the router hardware tends to be unresponsive and not in a good working condition you can contact us via support@keepyourhomeip.com.

11.2 In the event IPlumVPN B.V. arrives at the conclusion that the hardware is not in a good working condition, the two-year warranty will apply and you will be eligible for the exchange with a new device.

SECTION 12 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 13 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Certain content, products and Services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 16 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 17 - APPLICABLE LAW

These terms of service and any other claim, dispute or complaints are strictly governed by the laws of Netherlands. Based on the foregoing any grieved user may seek redress under the laws of Netherlands.

SECTION 18 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products/services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 19 - MISCELLANEOUS

You may link to our website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.

Chargebacks. We reserve the right to immediately suspend access to the Services, without prior notice, in the event that we receive notice of a Chargeback. A Chargeback is defined as any rejection, cancellation, or contesting of a charge related to your use of the Services, including contacting your bank or credit/debit card provider to dispute a charge.

You acknowledge that requesting a Chargeback will be considered a breach of your payment obligations under these Terms. We also reserve the right to dispute any Chargeback received in connection with your Account and may choose to delete your Account and restrict your future access to our Services if we believe, in our sole discretion, that you have maliciously requested a Chargeback.

Communication with IPlumVPN B.V. : You may provide notices, requests, information, and other communications to IPlumVPN B.V. via our customer support support@keepyourhomeip.com . You agree to receive communications from us electronically, e.g., by email, through our applications, and customer support platforms, and consent that such notifications have the same legal power as communication in writing. When communicating with our customer support representatives, you agree to be respectful and kind. In addition, you undertake to provide accurate data for communication with us. IPlumVPN B.V. is not liable if you do not receive certain notices upon your failure to update your contact details.

Prevailing Language: For all purposes, the English language version of the Terms shall be the original, governing instrument and understanding between you and us. In the event of any conflict between this English language version of the Terms and any subsequent translation into any other language, the English language version shall govern and control.
